Maine has specific legal deadlines and rules that can make or break your case. Understanding these statutes is critical to ensuring you don’t lose your right to compensation.

The Six-Year Statute of Limitations

In most car accident cases, the law grants you six years from the date of the crash to file a lawsuit. While this is one of the longest limits in the country, waiting is dangerous. Evidence disappears, and insurance companies often refuse to negotiate seriously as the deadline nears.

The 365-Day Notice Rule 

If you were hit by a MaineDOT truck, a local police cruiser, or a city bus, you have significantly less time. Under the Maine Tort Claims Act, you must file a formal notice of claim within 365 days of the accident. However, the 2-year statute of limitations for filing the actual lawsuit against a government entity still applies.

One exception is that while the 365-day limit is strict, a later notice may be permitted if “good cause” is shown for why the notice could not have reasonably been filed within that timeframe (e.g., if a representative of the government made direct contact with you that implied coverage, or if you were incapacitated).

Another exception is that if you were a minor at the time the cause of action accrues, the notice may be presented within 365 days of you attaining 18 years of age.

Wrongful Death Deadlines

If a collision results in a fatality, the timeline shifts. A wrongful death action must be filed within three years of the date of death. Given the complexity of these claims and the caps on non-economic damages, immediate legal action is vital to preserve the estate’s interests.

Hit-and-Runs and UM/UIM

Maine law requires all drivers to carry Uninsured/Underinsured Motorist coverage. What compensation can I get if I was the victim of Maine’s government negligence?

If your accident involved a government-owned vehicle, such as a postal truck, city bus, snowplow, or emergency vehicle, the rules for your recovery have changed.

Historically, Maine law strictly limited your total compensation to $400,000. However, as of 2026, the Maine Tort Claims Act recovery limit has been updated (via LD 1347) to a maximum of $1,250,000 per occurrence. This significant increase allows our firm to pursue a much higher level of justice for those injured by state or municipal negligence.

However, while the money limit has increased, the deadlines have not. You still must file a formal “Notice of Claim” within 365 days of the accident, or you may lose your right to recover entirely.

Once a settlement is reached and the release forms are signed, you can generally expect your funds to be disbursed within four to six weeks. Insurance companies typically process and mail the check to your Maine car accident lawyer’s office within 30 days.
